Privacy Statement GoodLife Foods candidates, temporary workers and candidate temporary workers
The purpose of this Privacy Statement is to inform the candidate temporary workers and temporary workers made available by GoodLife Foods about the way in which GoodLife Foods processes their personal data.
This statement therefore does not apply to the permanent staff of GoodLife Foods.
GoodLife Foods attaches the utmost importance to the privacy of temporary workers. It only uses the personal data of temporary workers for the purposes described in this privacy statement and takes appropriate technical and organizational measures that allow GoodLife Foods to operate within the applicable regulations on the protection of personal data.
1. What are personal data?
The General Data Protection Regulation defines personal data as follows:
“Any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”
If this Privacy Statement refers to personal data, reference is made to this definition from the Regulation.
No special categories of personal data are processed. Processing of special categories of personal data means:
“Processing of personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and processing of genetic data, biometric data for the purpose of uniquely identifying an individual, or data concerning health, or data concerning a natural person's sexual behavior or sexual orientation.”
2. Which personal data is processed, for what purposes does GoodLife Foods process this personal data and on what legal basis?
a. Prior to the execution of the temporary worker agreement, the temporary worker must provide GoodLife Foods with the necessary personal data and submit the documents required for the execution of the temporary worker agreement and the application of the applicable social, tax and labor legislation. GoodLife Foods considers the following information to be necessary:
- Surname and first name
- Date and place of birth
- Copy of identity card
- National register number
- Language(s).
- Gender
- Address
- Bank account number
- Civil status
- Spouse's name, date of birth, nationality and occupation
- Number of (disabled) dependents (children, spouse, other)
- Retirement status
- Function
- Wage
- Working hours
- Diploma(s)
- Professional experience
- Previous employer details
- Period of temporary employment
- Period of prior unemployment
This list is not exhaustive.
If the temporary worker refuses to provide the necessary personal data or to submit documents, GoodLife Foods reserves the right to suspend the execution of the temporary worker agreement. Of any change to these personal data, the temporary worker will inform GoodLife Foods spontaneously and without delay.
b. GoodLife Foods also stores additional personal data in the temporary worker file, the retention of which is required by law, such as:
- the temporary agency worker agreements and the appendices
- the individual accounts and their appendices
- the agreements for student employment
- the agreements for the employment of domestic workers
- the agreement for the performance of temporary work
- the professional empathy agreements
- work schedule of the part-time temporary workers and their deviation documents
- sliding timetables stating the work performed per day, and for a part-time temporary worker with a fixed timetable, also the start and end of the working day and the breaks
- Dimona declarations
c. GoodLife Foods also stores in the temporary worker file the personal data necessary for granting additional benefits and sanctioning the temporary worker in the context of GoodLife Foods' supervisory authority arising from the temporary worker agreement:
- temporary worker agreements and appendices
- notices of default, warnings, suspensions, notifications of the termination of the temporary agency worker agreement
- absences regardless of the reason
- C4, employment certificate, holiday certificates, tax form 281.10
d. GoodLife Foods also stores personal data in the temporary worker file with a view to protecting the legitimate interests of GoodLife Foods, such as monitoring the safety and health of temporary workers, controlling the production process, protecting the employer's confidential economic, trade and financial interests, protecting the employer's property.
The processing of personal data resulting from the above-mentioned checks is regulated in separate guidelines and/or policies and notified to the temporary worker in separate documents.
e. It is possible that GoodLife Foods, for example, for publicity reasons, requests to take an image/photo to publish on the website/social media, etc. In the latter case, the temporary worker's permission will always be requested, both for taking the image/photo and for its publication.
3. With which third parties is your personal data shared and why?
a. Internal:
GoodLife Foods ensures that no unauthorized persons can gain access to the temporary worker file and the personal data stored therein and takes all necessary internal and external security measures to this end. The management and the responsible HR employee(s) are authorized to inspect the temporary worker file and the personal data stored therein.
b. External:
The personal data of the temporary workers are provided to the social secretariat of GoodLife Foods, namely Partena, which processes these personal data on behalf of GoodLife Foods with the aim of reporting the employment and termination of employment of the temporary worker to the RSZ, conducting the personnel and payroll administration of GoodLife Foods, drawing up and transferring social documents, payment of wages ...
GoodLife Foods also provides personal data to the social security institutions to the extent necessary to safeguard the rights of the temporary worker vis-à-vis the social security institutions: RIZIV, health insurance funds, RVA, annual holiday funds, federal pension service, VDAB, industrial accident insurer, etc. or if GoodLife Foods is legally obliged to do so.
The following service providers of GoodLife Foods/temporary workers may become aware of and process personal data with a view to carrying out their assignment: bookkeeper, accountant, lawyers, insurance companies, banking institutions, IT suppliers, external consultants, trade organizations, etc.
Your personnel file can also be transferred to the audit firm to carry out an audit in the context of obtaining/maintaining the quality label of the professional federation.
In rare cases, we may have to disclose your personal data pursuant to a court order or to comply with other mandatory laws or regulations.
GoodLife Foods only uses service providers who offer adequate guarantees with regard to the application of appropriate technical and organizational measures to ensure that the processing complies with the applicable regulations on the protection of personal data.
If these service providers act as processors, GoodLife Foods guarantees that the necessary processing agreements are concluded and we make every effort to ensure that they adequately protect your personal data.
Your personal data will not be sold, rented, distributed or otherwise made commercially available to third parties, except as described above or with your prior consent.
4. How long will this personal data be kept by GoodLife Foods?
The personal data of candidate temporary workers will be kept for up to 5 years after the last qualitative contact. After the period has expired, you will be contacted again with the request to give your consent if you wish to remain in the database for longer to be contacted regarding available functions.
Qualitative contact is considered to be any contact with the candidate that ensures a further step in job placement (substantive discussion, tests, conditions, etc.). If a candidate temporary worker has not been employed, there has been no proven quality contact and has not again indicated that he is open to job placement, the data must in principle be deleted 5 years after the first registration.
The personal data of temporary workers who have actually worked with us are kept for 5 years after the conclusion of the last contract. After the 5-year period has expired, you will be contacted again with the request to give your consent if you wish to remain in the database for longer to be contacted to be enabled for certain functions.
In any case, your personal data will be kept in accordance with specific legislation, as well as limitation periods that oblige us to keep your personal data for a longer period, e.g. to defend ourselves against a legal claim.
5. Does GoodLife Foods intend to transfer the personal data outside Europe?
No.
6. Rights of the temporary worker with regard to the processing of his personal data
a. The temporary worker has the right to inspect and copy his personal data to the extent that the exercise of this right does not affect the rights and freedoms of others.
b. The temporary worker is entitled to have all incorrect personal data relating to him corrected.
c. Each temporary worker is entitled to request the deletion of all personal data concerning him that is incomplete or irrelevant, or whose registration, communication or storage is prohibited, or which has been retained beyond the permitted period. If the personal data has been made public, GoodLife Foods will take all reasonable technical measures to delete links to or copies of that personal data without being obliged to do so.
d. Any temporary worker can request that GoodLife Foods limit the processing of the personal data and therefore not process the personal data further, but still retain it:
- in the event of a dispute about the accuracy of the personal data by the temporary worker for the period necessary for GoodLife Foods to check the accuracy of the personal data.
- in the event of unlawful processing by GoodLife Foods
- if GoodLife Foods no longer needs the personal data, but the temporary worker needs them for the establishment, exercise or substantiation of a legal claim.
The request for restriction of processing does not prevent GoodLife Foods from using the personal data for the establishment, exercise or defense of a legal claim or for the protection of the rights of another natural or legal person. The temporary worker will be informed of this intention.
e. The temporary worker has the right to receive the personal data that he has provided to GoodLife Foods in a structured, commonly used and machine-readable form. The temporary worker can also request GoodLife Foods to transfer the personal data directly to another employer, if this is technically possible. The right to portability of personal data cannot be granted if this would prejudice the rights and freedoms of others.
7. Who to contact in case of questions?
GoodLife Foods, with registered office at Hanswijkstraat 3-5, 2800 Mechelen and registered in the Crossroads Bank for Enterprises under number 0669 836 567, is responsible for the processing of personal data. GoodLife Foods NV declares that, as controller, it complies with Belgian privacy legislation, as well as the provisions of the General Data Protection Regulation from its entry into force.

GoodLife Foods will inform the temporary worker as soon as possible and in any case within one month after receipt of the request of the response that GoodLife Foods NV has taken to the request:
- Granting the request
- Impossibility to communicate the consequences of the request to the temporary worker within one month due to the complexity of the request.
- Refusal of the request and the opportunity to file a complaint with the supervisory authority or appeal to the court.
- The need for additional information in case of doubt about the identity of the applicant. The requests are in principle granted by GoodLife Foods free of charge unless the temporary worker's request is manifestly unfounded or excessive, in particular due to their repetitive nature. In that case, GoodLife Foods may charge a reasonable administrative fee or refuse the request.
